Auction Method: The farmland will be offered in a virtual live online auction format. Bidding will be on a dollars per acre basis utilizing the Buyer's Choice Auction Method. The high bidder will have the opportunity to select either Tract 1, Tract 2, or both tracts at their high bid price, subject to the Seller's approval. If only one tract has been selected, the remaining tract will then be offered.
Reserve: Auction is with reserve. Seller reserves the right to accept or reject any and all bids.

Bidder Registration: All prospective bidders must register with Peoples Company and receive bidder approval prior to bidding. Peoples Company and its representatives are agents of the Seller. Winning bidder(s) acknowledge they are representing themselves in completing the auction sales transaction. Registration is due by Tuesday, October 27th at Noon CT.
2027 Farming Rights: The successful buyer(s) shall receive full farming rights for the 2027 crop year.
Farm Program Information: Farm Program Information is provided by the Vermilion County Farm Service Agency. The figures stated in the marketing material are the best estimates of the Seller and Peoples Company; however, Farm Program Information, base acres, total crop acres, conservation plan, etc. are subject to change when the farm is reconstituted by the Vermilion County FSA and NRCS offices.
CRP Information: Tract 2 includes approximately 1.61 acres enrolled in the Conservation Reserve Program (CRP) as a grass waterway. The current CRP contract expires on September 30, 2030. Seller shall transfer all rights and obligations of the contract to the Buyer. The payment due on September 30, 2026, will be retained by the Seller.
Earnest Money Payment: A 10% earnest money payment is required within 24 hours of the conclusion of the auction. Earnest money shall be paid in the form of a wire transfer. All earnest money funds shall be held by Vermilion County Title Company pending closing.
Closing: Closing shall occur on or before December 2, 2026. The balance of the purchase price shall be payable at closing in the form of guaranteed funds or wire transfer.
Possession: Possession shall be granted at closing, subject to any remaining rights of the tenant in the expiring farm lease. Buyer shall receive full farming rights for the 2027 crop year.
Farm Lease: The property is leased for the 2026 crop year. Seller shall retain all landlord income attributable to the 2026 farm lease. Buyer shall receive possession and full farming rights beginning with the 2027 crop year.
Property Improvements: Tract 1 includes an older residence, detached garage, Morton building, and several additional outbuildings. All improvements are being sold in their present "As Is, Where Is" condition. For additional information on the improvements, see the information provided by the Seller and the Vermilion County Assessor.
Contract & Title: Immediately upon conclusion of the auction, the successful bidder(s) shall enter into a real estate sales contract and deposit the required earnest money payment with Vermilion County Title Company. The Seller will provide a proper deed conveying merchantable title to the property, free and clear of any liens. Sale is not contingent upon Buyer financing.
Taxes: Seller shall pay all real estate taxes due and payable in 2026. Buyer shall be responsible for all real estate taxes due and payable in 2027 and thereafter.
Agency: Peoples Company and its representatives are agents of the Seller.
Other: This sale is subject to all easements, covenants, leases, and restrictions of record. All property is sold on an “As is – Where is” basis with no warranties, expressed or implied, made by the Auctioneer, Peoples Company, or Seller. All bids will be on a per-acre basis. Peoples Company and its representatives are agents of the Seller. The winning bidder acknowledges that they are representing themselves in completing the auction sales transaction. Any announcements made on auction day by the Auctioneer or Listing Agents will take precedence over all previous marketing material or oral statements. Bidding increments are at the sole discretion of the Auctioneer. No absentee or phone bids will be accepted at the auction without prior approval of the Auctioneer. All decisions of the Auctioneer are final.
